1. Purpose and scope

Puremium is a French company specializing in digital marketing.

Puremium is registered in the Paris trade and companies register under number 841 062 110 and its head office is located at 16, rue de la Ville L'Evêque in Paris (75008).

Puremium is the owner of the website accessible at the address http://www.puremium.com (the “  Site  ”) for the purpose of connecting users who are natural or legal entities (the “  User(s)  ”), who are looking for goods or services, and professionals who are natural or legal persons acting within the framework of their commercial, industrial, artisanal, liberal or agricultural activity, for themselves or on behalf of other professionals (the “  Professionals  ").

The service provided by Puremium is a connection service between the User and Professionals (the “  Service  ”).

This document aims to define the general conditions of use of the Site and the Service (the “  General Conditions  ”) and does not govern the relationship between Professionals and Puremium which is the subject of separate conditions.

2. Acceptance of the General Conditions

The User accepts the General Conditions in order to access the Site and subscribe to the Service.

If the User does not accept all or part of the General Conditions, he will have to give up access to the Site and the Service.

Puremium reserves the right to adapt or modify the General Conditions at any time by publishing an updated version of these General Conditions and informing Users of this modification.

The General Conditions applicable to the User are those in force on the day of use of the Site by the latter or on the day of subscription to a Service on the Site.

The User is invited to print without delay and keep for his archives a copy of the version of the General Conditions which will be applicable to him.

The User certifies that he holds all the rights necessary for the conclusion of these terms.

3. Service

Puremium offers, via its Site:

  • access to the Site (3.1) ;
  • an affiliation platform (3.2) .
3.1  Access to the site

The Site is accessible free of charge anywhere to any User with Internet access.

All costs incurred by the User to access the Site (computer hardware, software, Internet connection, etc.) are their responsibility.

3.2  Service

The Site only offers a connection between Users and Professionals, any contract for the sale of products or services being concluded directly between Users and Professionals.

In order to access the Service offered on the Site, the User completes the contact form and provides the information indicated by an asterisk and clicks on validate.

For more information on the conditions of use of this data, we invite you to consult the Puremium confidentiality policy available on the Site.

The User consents to the Service being immediately provided to him, and thus waives his right of withdrawal in accordance with article L.221-28 of the Consumer Code.

The Connection Service is free for the User and Puremium may receive remuneration from the Professional for any prospect provided.

The general conditions of sale of the service which bind Puremium and Professionals are accessible to Professionals on request.

4. LIMITATION OF PUREMIUM’S LIABILITY
4.1  ON ACCESS TO THE SITE

USERS ARE INFORMED OF THE TECHNICAL HAZARDS INHERENT IN TELECOMMUNICATION NETWORKS AND THE INTERNET, AND OF INTERRUPTIONS OF ACCESS WHICH MAY RESULT THEREFOR OR RESULT FROM ITS OWN OR THIRD-PARTY SERVICE PROVIDERS. PUREMIUM IS THUS NOT ABLE TO GUARANTEE CONTINUITY OF ACCESS TO THE SITE OR THE SERVICE, EXECUTED REMOTELY, VIA THE INTERNET OR ANY TELECOMMUNICATION NETWORK, WHICH THE USER ACKNOWLEDGES.

PUREMIUM HAS AN OBLIGATION OF MEANS WITH REGARD TO USERS' ACCESS TO THE SITE.

PUREMIUM RESERVES THE RIGHT TO TEMPORARILY SUSPEND ACCESS TO THE SITE FOR TECHNICAL OR MAINTENANCE REASONS WITHOUT THESE OPERATIONS GIVING RIGHT TO ANY COMPENSATION.

IN ANY CASE, THE LIABILITY LIKELY TO BE INCURRED BY PUREMIUM UNDER THE PRESENT IS EXPRESSLY LIMITED ONLY TO DIRECT DAMAGES SUFFERED BY THE USER.

4.2  ON THE USE OF THE SITES BY THE USER OR A THIRD PARTY

THE USER IS SOLELY RESPONSIBLE FOR THEIR USE OF THE SITE.

PUREMIUM CANNOT BE HELD LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES RESULTING FROM THE USE OF THE SITE BY THE USER OR BY AN UNAUTHORIZED THIRD PARTY.

GENERALLY, WHEN IT HAS COMPLIED WITH ITS OBLIGATIONS, PUREMIUM CANNOT BE HELD LIABLE FOR DAMAGES SUFFERED DUE TO THE USER AND/OR A THIRD PARTY.

4.3  ON THIRD PARTY WEBSITES

THE SITE MAY INCLUDE HYPERTEXT LINKS TO OTHER WEBSITES OWNED OR OPERATED BY PERSONS OTHER THAN PUREMIUM.

THE LINKED SITES ACCESSIBLE VIA THE SITE ARE INDEPENDENT SITES OVER WHICH PUREMIUM HAS NO CONTROL, WHETHER FINANCIAL, EDITORIAL OR OF ANY OTHER NATURE AND THEY ARE IN NO WAY ENDORSED BY IT.

PUREMIUM CANNOT BE LIABLE IN ANY CIRCUMSTANCES DUE TO THE PRODUCTS AND SERVICES OFFERED AND THE CONTENT OF THESE THIRD-PARTY WEBSITES.

4.4  ON INDIRECT DAMAGES

PUREMIUM CANNOT BE LIABLE FOR LOSS OF PROFITS, COMMERCIAL LOSSES, LOSS OF DATA OR LOST PROFITS OR ANY OTHER INDIRECT DAMAGE OR WHICH WAS NOT FORESEEABLE DURING THE USER'S USE OF THE SITES.

4.5  ON THE FORTUITIVE EVENT AND FORCE MAJEURE

THE RESPONSIBILITY OF PUREMIEUM SAS CANNOT BE ENGAGED IN THE EVENT OF THE OCCURRENCE OF AN FORTITUTE EVENT (IT, TECHNICAL PROBLEMS, ETC.) OR AN EVENT OF FORCE MAJEURE AS DEFINED BY ARTICLE 1218 OF THE CIVIL CODE AND FRENCH JURISPRUDENCE .

5. Personal data

As part of the use of the Site, Puremium is required to collect and process certain personal data of the User, including their geolocation, their IP address, connection and navigation data and data recorded in the cookies (the “  Data  ”).

Puremium ensures that the User collects and processes their Data in compliance with the provisions of Law No. 78-17 of January 6, 1978 relating to data processing, files and freedoms (amended by Law No. 2004). -801 of August 6, 2004, law no. 2016-1321 of October 7, 2016, law no. 2018-493 of June 20, 2018 and ordinance no. 2018-1125 of December 12, 2018) (the “Computer  and Freedoms  ") and Regulation No. 2016/679 of the European Parliament and of the Council of April 27, 2016 (the "  Regulation  "), in accordance with its Privacy Policy accessible on the Site and the following address: http://www. puremium.com/cgu

The User must consult the Privacy Policy, to which he is referred for a more detailed explanation of the conditions of collection and processing of User Data.

Under the provisions of the Data Protection Act and the Regulations, the User has the right to access, rectify, delete their Data, limit or oppose their processing, the right to define directives relating to the conservation, erasure and communication of their Data after their death and the right to portability of their Data.

Puremium is committed to ensuring that adequate levels of protection exist in accordance with applicable legal and regulatory requirements. However, since no mechanism offers absolute security, some risk remains when the Internet is used to transmit Data.

Puremium will notify the CNIL and/or the User concerned of any Data violations covered by the Regulations.

6. Puremium Obligations

Puremium implements all means at its disposal to ensure quality access to the Site and the Service.

The obligation being of means, the Company does not undertake to achieve this result.

7. Compliant and fair use of the Service

The User is prohibited from using the Puremium Site and Services contrary to the regulations in force, and more generally is prohibited from harming the interests, notoriety, reputation or image of Puremium. .

8. Property rights – License

The Site and its content, including informative content and visual elements, whether or not registered as a trademark or another title, are the exclusive property of Puremium or third parties with whom the latter has concluded agreements. agreements allowing their reproduction, distribution and exploitation. The User does not have the right to reproduce, distribute or more generally exploit this content, in whole or in part, notwithstanding the means used, without having obtained the prior written consent of Puremium.

Puremium grants the User a limited, non-exclusive, non-transferable and strictly personal right to use, depending on the case, free of charge or for a fee, the Site and its content.

Apart from the rights granted in this article and without prejudice thereto, the User is not authorized hereunder to:

  • copy, print or transfer all or part of the Site or its content;
  • sell, distribute, rent or sublicense in any way all or part of the Site or its content;
  • modify the Site or its content;
  • reproduce or merge all or part of the Site or its content in other computer programs;
  • compile the Site or its content, decompile, disassemble, translate or analyze them, except within the limits authorized by French law;
  • use the Site or its content for purposes other than their original function.
9. Nullity / Non-applicability

If any of the stipulations of these General Conditions proves to be null or non-applicable with regard to a rule of law in force or a judicial decision which has become final, it will then be deemed unwritten, without however resulting in the nullity of the General Conditions which contain it, nor alter the validity of their other stipulations, unless the stipulation canceled or rendered non-applicable is an essential stipulation of said General Conditions.

10. Edition and hosting

The Site is published and operated by the company Puremium.

11. Modification

Puremium reserves the right to modify the General Conditions at any time.

Each modification will take effect from the time it is put online on the Site. Puremium undertakes to inform members in advance by email or by posting on the Site. If the modification is refused, the User must no longer use the Site or Service affected by the modification. Any use of the Site or the Service after the modification is posted online constitutes acceptance of said modification.

Puremium will make its best efforts to respond to the User within 7 days.

In the event of contestation of the solution proposed by customer service, the User may (but without obligation) resort free of charge to the consumer mediation system described by articles L.612-1 et seq. of the Consumer Code, in a period of one (1) year from the first written complaint.

13. Applicable law and competent jurisdiction

The French version takes precedence over any other version of the General Conditions.

These General Conditions are subject to French law. Puremium and the User will endeavor to find an amicable solution for possible disputes related to the formation, interpretation and/or execution of the General Conditions.

For any complaints, the User is invited to contact the Complaints department whose contact details are as follows: by post to the head office address or by email infodata@puremium.com

Failing an amicable solution, any dispute resulting from the formation, interpretation and/or execution of the General Conditions will fall under the jurisdiction of the courts of Paris.
